For years, UAE businesses have asked the same question at every VAT return filing: can we recover the input tax on what we provide our staff for free? Transport to site, accommodation near the job, phones for remote work, meals at a remote location? The answer was always “it depends” — because the rules were not written down in one place. FTA Decision No. 17 of 2026 changes that. As of 1 October 2026, there is a definitive, binding answer for each expense type.
At Essence, we have reviewed the Decision against Article 53 of the UAE VAT Executive Regulation and mapped every condition. Below is the complete breakdown — written for finance managers, CFOs, and business owners who need to act on this before their next VAT return.
What Is FTA Decision No. 17 of 2026?
FTA Decision No. 17 of 2026 — formally titled “Cases and Conditions for the Recovery of Input Tax on Employee Expenses” — was issued by the UAE Federal Tax Authority on 9 September 2026 and entered into force on 1 October 2026. It applies to all VAT-registered businesses (taxable persons) in the UAE when they purchase goods or services to provide to employees free of charge, where that provision is required under an employment contract or a formal, documented HR policy.
The Decision does not create new VAT-exempt benefits or change what businesses must provide their staff. It draws a precise boundary: here are the six situations in which you can claim the input tax back, and here are the specific conditions every situation demands. Miss any single condition in a category and the VAT on that expense becomes blocked input tax.
It is also worth noting what the Decision does not govern. Health insurance for employees and qualifying family members (one spouse, three children under 18) is recoverable under Article 53(1)(c)(3) of the Executive Regulation and is entirely separate from Decision 17/2026. Client entertainment and motor vehicles available for personal use remain blocked under Article 53(1)(a) and (b) respectively — the Decision does not change that.
The Six Recoverable Employee Expense Categories
Each category below is a direct translation of Article 2 of Decision 17/2026. All listed conditions are mandatory — they are not a checklist where most will do.
1. Employee Transport — Article 2, Clause 1
VAT on staff transport services is recoverable where three conditions are all satisfied:
- The transport runs only between the employee’s residence and workplace, to clients’ premises, or for other purposes directly related to their job duties — no personal trips.
- The service is not used for the employee’s personal benefit.
- The employee cannot opt to receive a cash allowance or financial compensation in place of the transport.
The cash-option condition is critical. If your transport policy allows an employee to take a monthly allowance instead of using the company shuttle, the VAT on that shuttle becomes blocked for all employees who have the option — even those who never take the cash.
2. Food and Beverages — Article 2, Clause 2
This is one of the Decision’s narrowest categories. It is not designed for office canteens or daily lunch subsidies — it targets genuine operational necessity at remote or isolated work locations. All four conditions must be met:
- The employee’s residence is in a remote, distant or isolated area.
- No appropriate food-preparation facilities exist at the residence or workplace, and no nearby restaurants or food outlets where the employee can reasonably obtain food.
- The provision of food is directly linked to the work period or the residence period required by the nature of the job.
- The employee cannot choose a cash allowance instead.
If your office has a cafeteria, or your employees are based in an urban area with accessible food options, this category will almost certainly not apply.
3. Work-Necessitated Accommodation — Article 2, Clause 3
Accommodation VAT is recoverable only when housing is an operational necessity — not a compensation element or standard employment benefit. Five conditions apply:
- The employee cannot opt for a cash allowance or financial compensation in lieu of the accommodation.
- The accommodation is related to operational work requirements and does not form part of the employee’s standard benefits or compensation arrangements.
- The nature of the work requires the employee to reside near the workplace, work site, or client’s location.
- The accommodation is designated exclusively for that employee — family members and others are excluded, unless the employee must reside there permanently as their usual residence.
- The accommodation matches job requirements and basic residency needs, with no significant recreational or personal elements beyond its functional work purpose.
Read these conditions together: a furnished apartment provided as part of an employment package, with no operational necessity and a cash-in-lieu option in the contract, will almost certainly fail this test.
4. Temporary Accommodation for New Employees — Article 2, Clause 4
A simpler, narrower sub-category for onboarding situations. Two conditions:
- The accommodation is temporary, for a period of no longer than 30 days.
- It is commensurate with job requirements and basic residency needs.
Short-term hotel or serviced apartment costs for new joiners relocating to the UAE can qualify under this clause, provided the stay does not exceed 30 days and the accommodation standard is appropriate to the role.
5. Mobile Phones, Airtime, Data and Home Internet — Article 2, Clause 5
Four conditions must all be satisfied:
- The phone, airtime, data, or home internet is necessary for the employee to perform job duties — including outside standard working hours or away from the workplace, such as remote work and business communication.
- Use is limited to work purposes; any personal use is incidental, insignificant, and not the primary purpose.
- The employer maintains a documented internal policy defining permissible use and the consequences of unauthorised use.
- The employer can demonstrate reasonable monitoring mechanisms to track usage and verify compliance, with records retained.
The monitoring and documentation requirements here are the most demanding of all six categories. If you are currently recovering VAT on company phones or internet allowances without a written policy and usage monitoring in place, your position is at risk.
6. Parking Fees — Article 2, Clause 6
Three conditions apply to parking recovery:
- Fees are incurred solely for business purposes, directly related to job duties or business visits and assignments.
- A documented internal policy regulates when employees may be reimbursed for parking, including the approval mechanism.
- Payment documents are retained — receipts showing date, time, amount, and the VAT charged.
The Pattern the FTA Has Built
Across all six categories, the FTA has applied the same three-part test: (1) genuine business or operational purpose, (2) no cash-in-lieu option for the employee, and (3) documentation — contracts, policies, receipts, monitoring records. The message to businesses is clear: free-form staff perks without policies, with optional cash equivalents, will not generate recoverable input tax. Formalise the benefit or lose the recovery.
This is also closely connected to the broader UAE input tax recovery rules under Article 53 of the VAT Executive Regulation. Decision 17/2026 fills the gap that Article 53 left open specifically for employee expenses.
Your October 2026 Compliance Checklist
- Audit every free-of-charge employee benefit against the six categories — transport, food, accommodation (work-necessitated), accommodation (new joiner), phones/internet, parking.
- Verify employment contracts and HR policies state each benefit as a contractual obligation or documented policy — not a discretionary perk.
- Remove or restructure cash-in-lieu options attached to transport, food, or accommodation benefits if you intend to recover the VAT.
- Issue a written mobile-phone and internet usage policy with clear monitoring mechanisms and retained usage records.
- Centralise parking receipts showing date, time, amount, and VAT — do not accept unitemised vouchers.
- Reclassify blocked input tax in your next VAT return — do not wait for an FTA review to identify the error.
- Retain all supporting documents for the full retention period required under the UAE Tax Procedures Law.

Only where the accommodation is an operational necessity: the work must require the employee to live near the site, it must not be part of their compensation or benefits package, there must be no cash-in-lieu option, it must be used exclusively by that employee, and it must not include recreational or personal elements beyond its work purpose. All five conditions apply.
